The agreement between us.

01Who we are and what these terms cover

These terms govern your use of the WebHostGB website design, hosting and management service. By starting a website with us, or by paying your first invoice, you agree to them.

Throughout, "we" and "us" mean WebHostGB, and "you" means the person or business taking the service. If you are agreeing on behalf of a company, you confirm you are authorised to do so.

02What the service includes

We design, write and build a website with a page structure based on your business requirements and the scope confirmed before payment; register a domain for you or connect one you already own; host the site with an SSL certificate, daily backups and uptime monitoring; provide the customer tools described on our features and pricing pages; and make up to ten changes to the website per rolling thirty-day period.

The design and copy are produced specifically for your business from the information you give us. We choose the layout, typography, colour and photography. You get to review the finished site and ask for changes before it goes live, and we will keep making changes at that stage until you are happy.

The service can link to an HTTPS booking, payment, messaging or quotation service that you choose, but does not include building or operating those third-party services. E-commerce, booking and payment engines, customer logins or member areas, custom application development, ongoing SEO or advertising campaigns, and work materially outside the website scope confirmed before payment are not included. If you need any of those, we will tell you plainly rather than take the work.

03What we need from you

We need accurate information about your business, and we need it to be yours to give. You are responsible for making sure any text, images, logos or trade marks you send us are ones you own or are licensed to use, and that the services you describe are ones you are legally able to provide.

You agree not to use the service for anything unlawful, and not to ask us to publish content that is defamatory, discriminatory, misleading, infringing, or otherwise likely to cause harm. We can refuse a change request or take a site down if it breaches this, and we will explain why if we do.

If a regulator requires specific wording on your website for your trade -- financial promotions, medical claims, licensing details -- providing that wording is your responsibility. We will include what you give us, but we are not qualified to check it.

You are responsible for using enquiry replies, follow-up reminders and review requests lawfully. Review requests must only be sent to genuine customers who would reasonably expect that contact, and must not be used for unsolicited marketing. We send every recipient to the same public review destination and do not provide review gating.

If you use Job-to-Proof or another publishing tool, you confirm that the project facts are accurate, that you may publish the photographs, and that any named or attributed customer has agreed to the quote and attribution shown. Promotional drafts remain private until you choose to use or publish them.

04Price, payment and VAT

The service costs £47 per month, inclusive of VAT, with no setup fee. Payment is taken monthly in advance by card through Stripe, our payment processor. We never see or store your card details.

Nothing is charged until you have completed setup, reviewed the proposed scope and confirmed you want to proceed. Your first payment starts both the subscription and the design and writing work.

You review every page privately before the website first goes live. If you have not approved launch and, after giving us a reasonable opportunity to make the revisions you requested, you decide the website is still not right, you may cancel and ask us to refund the first monthly payment. This pre-launch refund applies only to the first payment for that website and ends when you approve it for launch.

If we ever change the price, customers already subscribed keep the rate they joined on for as long as their subscription remains active and continuous.

If a payment fails we will email you and retry. Your website stays online while we do. If payment has not succeeded after our retries, we may suspend the service -- we will always contact you before that happens.

05Changes and revisions

Your subscription includes ten change requests per rolling thirty-day period. One request means one instruction, however large: updating every price on a page is one change, not eleven.

We aim to complete most changes within one business day. We do not guarantee a turnaround time, but we will tell you if something will take longer.

Changes made during the initial review, before your site first goes live, do not count towards your monthly allowance. Neither do corrections to errors we introduced.

If an automated change cannot be completed, it does not consume one of your ten and we will tell you so.

06Your domain name

Any domain we register for you is registered in your name, with you as the legal registrant. It is yours, not ours.

If you leave, we will transfer the domain to any registrar you nominate at no charge. We will not withhold a domain, charge a release fee, or make transfer conditional on anything.

Domain registration is subject to the rules of the relevant registry, and we cannot guarantee that any particular domain will be available.

07Intellectual property

Once you have paid for at least one month of service, you own the design, copy and images that make up your website, and you may continue to use them if you leave. On request we will provide the built HTML, CSS and images so you can host the site elsewhere.

Photography we licence on your behalf is licensed for use on your website. Some stock licences do not extend to unrelated uses such as print advertising or merchandise, so ask us before reusing an image elsewhere and we will tell you what the licence allows.

We keep ownership of the underlying platform, tooling and templates used to produce and host the site. Nothing in these terms transfers those to you.

You keep ownership of everything you send us -- your logo, your photographs, your words -- and you grant us permission to use them for the purpose of building and running your website.

08How we build your site

We use software tools, including automated content generation, as part of producing your website. Information you give us about your business is processed by those tools for that purpose. Our Privacy Policy names the providers involved.

Every site is reviewed by a person before it is shown to you, and again before it goes live. You will always see and approve the finished site before it is published.

09Availability

We aim for your website to be available at all times, and we continuously monitor uptime and important website paths. Contact-form assurance uses an inert test that does not create a customer enquiry or send a notification. We do not offer a contractual uptime guarantee or service credits at this price point, and we would rather say that plainly than bury it.

We may occasionally need to take the service down for maintenance. Where that is planned, we will give notice.

We are not responsible for downtime caused by things outside our control, including your domain registrar, your DNS settings if you manage them yourself, or a general internet or upstream provider failure.

10Cancelling

You can cancel at any time from your billing page. There is no notice period, no minimum term and no cancellation fee.

When you cancel, your website stays online until the end of the period you have already paid for, plus a further seven days. After that we may take it offline and stop hosting it.

Before that happens, ask and we will send you a copy of your site's files. Your domain remains yours regardless, and we will transfer it wherever you want.

We may end the service ourselves by giving you thirty days' written notice, or immediately if you breach these terms in a way that is serious or that you do not put right after we have asked. If we end it without cause, we will refund any period you have paid for and not received.

11Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability to you in any twelve-month period is limited to the amount you paid us in that period.

We are not liable for lost profits, lost business, lost data, or losses that were not reasonably foreseeable when we entered into this agreement. Your website is a marketing tool; you should not rely on it as your only record of anything.

If you are a consumer rather than a business, these terms do not affect your statutory rights.

12Changes to these terms

We may update these terms. If a change materially affects your rights, we will email you at least thirty days before it takes effect, and you are free to cancel in that period if you do not accept it.

The version published on this page is the one that applies.

13Law and jurisdiction

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
